Concerns Over Evacuations
The Office of the United Nations High Commissioner for Human Rights (OHCHR) issued a statement on Friday expressing serious concerns regarding the legality of recent Israeli evacuation orders in Gaza. The OHCHR underscored the apprehension that such actions might lead to the permanent displacement of the Palestinian population.
Legal Framework
The UN body noted that while Israel is permitted under international law to implement temporary evacuations under specific conditions, the current nature and breadth of these orders raise suspicions about Israel’s intentions to forcibly transfer civilians. This could constitute a violation of the Fourth Geneva Convention as well as the Rome Statute.
Article 49 of the Fourth Geneva Convention explicitly prohibits both individual and mass forcible transfers of protected persons from occupied territories, irrespective of intent. Additionally, Articles 7(1)(d) and 8(2)(b)(viii) of the Rome Statute classify the deportation of individuals from occupied regions without lawful justification as potential war crimes and crimes against humanity.
